Erica Baker, deputy chief of the Truth or Consequences Police Department, is no longer in the city’s employ as of July 19, according to Chief of Police Victor Rodriguez, who said he could not comment on any aspect of her departure.
Reached by phone today, Baker also responded that she had no comment after suggesting that the Sun “speak to my attorney” and providing his contact information.
Philip B. Davis of Davis Law Firm of New Mexico, based in Albuquerque, did not return the Sun’s phone call by press time today.
According to its website, the Davis Law Firm specializes in “federal and state law civil rights claims” and has expertise in “police misconduct, whistleblower, speech retaliation, fair pay, discrimination and personal injury” cases.
The cause of Baker’s separation from the police force may be related to “threatened or pending litigation” that was discussed by the T or C City Commission in closed session on May 26 and June 23, according to meeting agendas. The agenda items named Erica Baker and Michael Lanford, the latter also a police officer with the city, but did not reveal the subject of the threatened or pending litigation or which party was the potential plaintiff or defendant.
No action was taken after either of the closed sessions, according to commission meeting minutes. Mayor Sandra Whitehead recused herself from the May 26 discussion, according to the minutes, because Lanford is her son in law.
The Sun called the city police department on July 21 and asked to speak with Lanford and was told he was no longer employed there. Chief Rodriguez later confirmed Lanford was no longer with the police department as of June 25. The Sun could not reach Lanford by phone.
The Sun filed an Inspection of Public Records Act request on July 21 for resignation letters submitted by Baker and Lanford, and the city clerk responded: “No such documents exist.”
The Sun also requested any legal correspondence to or from the city concerning Baker and Lanford and as yet has received no response.
According to New Mexico Court Case Lookup, neither Baker nor Lanford nor the city has filed a court case naming the other or others as plaintiff or defendant.
