Truth or Consequences Mayor Pro-Tem Brendan Tolley announced during the Aug. 26 City Commission meeting, “I’ve developed some health issues that don’t allow me to serve,” stating he would be resigning immediately.
Tolley did not give details on his health problems and did not immediately respond to a phone call from the Sierra County Sun.
Tolley garnered 601 votes, the most among 13 candidates running for three seats in the March 3, 2020 election.
He and Amanda Forrister and Randall Aragon took their City Commission seats mid-April, giving them three and one-half months of service so far.
When a vacancy occurs on the City Commission, State law 3-14-9 gives one option for filling the seat, appointing a person until the next local election.
The law states, “If a vacancy occurs in the commission, the remaining elected and appointed commissioners shall, by a majority vote, appoint a qualified elector to fill the vacancy until the next regular local election, at which time a qualified elector shall be elected to fill the remaining unexpired term, if any.”
The City Commission recently voted to let Sierra County run their elections, which shaves about three months off each City Commissioner’s term, since the county’s election calendar coincides with the State’s.
The next election for City Commission is therefore November 2021, in which Mayor Sandra Whitehead’s and City Commissioner Paul Baca’s terms are up, and now Tolley’s seat will be added to that election ticket.
The City Commission may pick an appointee from candidates who ran in the March 3, 2020 election, since they were willing to serve and the public’s opinion may be gauged by the number of votes they garnered.
Tolley’s seat was Position 4. If the City Commission goes by the geographic district in selecting an appointee, mirroring the election, it would have a field of three appointees. Gina Kelley got the second-most votes after Tolley—229 votes. William Fink had 67 votes and Sophia Peron had 12 votes.
The City Commission may look at all other candidates who ran.
In Position 2, Aragon won with 283 votes. William Jacka had 266 votes, Carol Borsello 228 votes and Ingo Hoeppner 146 votes.
In Position 5, Amanda Forrister won with 300 votes. George Szigeti had 214 votes, Tony Archuleta had 200, Ron Fenn had 176 votes and Martin Mijal had 30 votes.
If the City Commission selects an appointee from all positions, using highest number of votes as a gauge, the field of appointees would be William Jacka, with 266 votes, followed by Gina Kelley, with 229 votes and Carol Borsello, with 228 votes.
