A two-year contract was signed by Mayor Sandra Whitehead the next day, setting his pay at the same amount, $95,000 a year, from Dec. 28, 2019 through Dec. 27, 2021.
The Sierra County Sun requested the City Commission evaluation documents and the Madrid’s contract, but only the contract was given.
The State Open Meetings Act and Open Records Act allow the City Commission to keep the evaluation behind closed doors and the evaluation documents sealed.
Some perquisites Madrid receives include a City vehicle at all times except when on “leave.” The City will pay for all aspects of the vehicle, including insurance, “operation” and maintenance.
A computer, software and cell phone are paid for by the City.
The City also pays for Madrid’s retirement contribution.
He accrues eight hours of vacation per pay period or 26 days a year. Sick leave accrues at half that rate or 13 days a year.
Professional training and travel are encouraged under the contract, with mileage, per diem and hotel fees paid by the City.
Madrid is “indemnified” against all legal action unless he is found to have acted with “willful or wanton misconduct.” He will have all his legal fees paid, including through the appeals process.
There is no provision for severance pay. If he wants to leave he must give 30-days’ notice, but none is required by the City Commission. If the City Commission lets him go before June 28, 2020, he gets nothing. Otherwise he is due accrued vacation hours up to 480 hours or 20 days.
